To the maximum extent permitted by applicable law, your exclusive remedy under this EULA is to return any defective media within 30 days of delivery along with a copy of your payment receipt and Red Hat, at its option, will replace it or refund the money you paid for the media. In nessun caso la responsabilità di Red Hat o delle società ad esso collegate, del distributore autorizzato o del licenziante che ha fornito un componente all’Utente, ai sensi del presente EULA supererà la somma che l’Utente ha pagato a Red Hat per il supporto ai sensi del presente EULA. 5. Controlli sull’Esportazione. Come richiesto dalle leggi degli Stati Uniti e degli altri paesi, l’Utente dichiara e garantisce quanto segue: (a) di riconoscere che i Programmi e i loro componenti potranno essere soggetti a controlli sull’esportazione in base all’U.S. Commerce Department’s Export Administration Regulations (“EAR”); (b) che essi non si trovano in una nazione in cui sia vietata l’esportazione in base all’EAR o a sanzioni del Governo degli Stati Uniti (attualmente Cuba, Iran, Iraq, Libia, Corea del Nord, Sudan e Siria, salvo cambiamenti comunicati dal governo degli Stati Uniti); (c) di non esportare, riesportare o trasferire i Programmi verso alcuna destinazione, individuo o enti inclusi nello “U.S Bureau of Industry and Security Denied Parties List or Entity List” o nella lista “U.S. Office of Foreign Assets Control List of Specially Designated Nationals and Blocked Persons” o in qualsiasi elenco simile compilato da altri paesi senza la/e necessaria/e licenza/e di esportazione o autorizzazione/i (d) di non utilizzare o trasferire i Programmi per l’utilizzo connesso ad alcuna arma nucleare, chimica o biologica, o ad alcuna tecnologia missilistica o per utilizzo militare laddove sia stato proibito a causa di un embargo sulle armi applicabile salvo sia stato autorizzato dalla relativa agenzia governativa mediante una normativa o una licenza specifica (e) nel caso in cui si trovi negli Stati Uniti ed esporti o trasferisca i Programmi a utenti finali idonei, di riconoscere e accettare, nella misura richiesta dall’Articolo 740.17 (e) dell’EAR, di presentare rapporti semestrali al Commerce Department’s Bureau of Industry and Security, che includano il nome e l’indirizzo (inclusa la nazione) di ciascun destinatario; e (f) di riconoscere che le nazioni comprendenti gli Stati Uniti potrebbero limitare l’importazione, l’utilizzo o l’esportazione di prodotti crittografici (che potranno comprendere i Programmi e i loro componenti) e accetta di essere l’unico responsabile dell’osservanza di qualsiasi restrizione all’importazione, all’uso o all’esportazione 6. Programmi di Terze Parti. Red Hat potrà distribuire, unitamente ai Programmi, programmi software la cui titolarità spetta a soggetti terzi e che non sono parte dei Programmi. Tali programmi di terzi non sono richiesti per l’utilizzo dei Programmi, sono forniti all’Utente per sua comodità e sono soggetti a proprie condizioni di licenza. Le condizioni di licenza possono essere allegate ai programmi software di terzi o essere visionate all’indirizzo http://www.redhat.com/licenses/thirdparty/eula.html. Qualora l’Utente non accetti di attenersi alle condizioni di licenza applicabili per tali programmi software di terzi, l’Utente non dovrà installarli. Qualora l’Utente desideri installare i programmi software di terzi su più di un sistema o trasferire gli stessi a terzi, l’Utente dovrà contattare il licenziante di tali programmi software di terzi. 7. Clausole Generali. In caso di discrepanza tra la versione italiana e la versione inglese del presente EULA, la versione inglese prevarrà. Se qualsiasi clausola del presente EULA sarà ritenuta inapplicabile, ciò non avrà alcuna influenza sull’applicabilità delle rimanenti clausole. Ogni domanda, contestazione o controversia derivante dal o relativa al presente EULA sarà regolata dalle leggi dello Stato di New York e degli Stati Uniti, senza riguardo alle norme di diritto internazionale privato. I diritti e gli obblighi delle parti ai sensi del presente EULA non saranno regolati dalla Convenzione delle Nazioni Unite sulla Vendita Internazionale di Beni. Copyright © 2010 Red Hat, Inc.
